Who we are
These Terms and Conditions (“Terms”) govern your access to and use of the Alliance Environmental Services website at https://www.alliancehazmat.com
 (the “Site”) and any estimates, proposals, purchase orders, work authorizations, and services we provide (“Services”). “Alliance,” “we,” “us,” and “our” mean Alliance Environmental Services.

Acceptance of terms
By using the Site, requesting a quote, signing a proposal, issuing a PO, or allowing our crews to mobilize, you agree to these Terms. If you do not agree, do not use the Site or our Services.

Changes to terms
We may update these Terms at any time. The effective date above shows the latest version. Your continued use of the Site or Services after changes means you accept the updated Terms.

Website use and content
The Site and its content are provided for general information only. We try to keep information current but do not guarantee accuracy, completeness, or availability. You may not copy, scrape, or misuse the Site. We may modify or discontinue the Site at any time.

Quotes, proposals, and scope
All estimates and proposals are based on information available at the time and are valid for the period stated (or 30 days if none stated). Pricing assumes clear, safe access; normal site conditions; standard work hours; and disposal pathways customary for the described waste/materials. Hidden conditions, changes to scope, schedule constraints, special permitting, or disposal restrictions may require a change order.

Customer responsibilities
You agree to:
disclose known hazards and provide available surveys, plans, and prior reports;
provide safe access, utilities, and staging;
secure all required owner permissions and, if the contract states you will, obtain permits;
keep non-work areas clear and protect your personal property;
coordinate with your other contractors so our work can proceed without delay.
Hazardous materials and assumptions
Environmental and abatement work often involves uncertainty. Unless our written scope states otherwise, we do not perform full site characterization or assume responsibility for materials not identified in a survey, report, or the contracted scope. If lab results, field screening, or regulator direction identify additional hazardous materials or more stringent handling, we will pause, notify you, and price a change order.

Compliance and safety
We perform Services in accordance with applicable laws and industry standards, including OSHA/Cal-OSHA, EPA, and local requirements. You agree to maintain a safe site for our crews and to notify us promptly of any incident or unsafe condition.

Schedule and force majeure
We will use commercially reasonable efforts to meet agreed schedules. We are not responsible for delays caused by weather, disasters, strikes, supply chain disruptions, permit delays, utility issues, third parties, owner-caused delays, or other causes beyond our reasonable control. Additional costs from such delays may be billed at our standard rates.

Subcontractors
We may use qualified subcontractors and suppliers to perform portions of the work. We remain responsible for managing our subcontractors for the Services we provide to you.

Change orders
Changes to scope, quantities, access, regulatory requirements, disposal profiles, or schedule constraints will be handled through written change orders. We will not proceed with extra work without written authorization, except to address immediate safety or environmental risks.

Pricing, invoicing, and payment
Unless stated otherwise on your estimate or invoice, payment terms are those listed on the invoice or contract. You agree to pay undisputed amounts when due. Past-due balances may incur a late charge as permitted by law and reasonable collection costs. We may suspend work for nonpayment. We reserve lien and stop notice rights where applicable.

Emergency response and after-hours
When you request emergency mobilization or after-hours work, premium rates, minimum call-out charges, and standby time may apply as stated in your estimate or our standard rate sheet.

Disposal and documentation
We will package, label, transport (or coordinate transport), and dispose of waste at appropriate facilities consistent with the scope and profile approvals. At closeout, we will provide reasonable documentation (e.g., manifests, chain-of-custody, tickets, and photo logs) reflecting the contracted Services.

Limited warranty
We warrant that our Services will be performed in a good and workmanlike manner consistent with industry standards and the written scope. Your sole and exclusive remedy for breach of this warranty is for us to re-perform the nonconforming Services within a reasonable time. We do not warrant conditions outside our control, including recontamination, future water intrusion, future mold growth, or materials installed or disturbed by others.

Disclaimers
Except as expressly stated in these Terms or your written contract, we disclaim all other warranties, express or implied, including implied warranties of merchantability and fitness for a particular purpose. Site content is provided “as is” without warranties.

Limitation of liability
To the maximum extent permitted by law, our total liability arising out of or related to the Site or the Services is limited to the amount you paid to us for the specific Services giving rise to the claim. We are not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, lost profits, loss of use, or business interruption.

Indemnification
You agree to indemnify and hold Alliance, its owners, employees, and subcontractors harmless from claims, damages, fines, and costs arising from: (a) your breach of these Terms or your contract; (b) undisclosed hazards or conditions you knew or reasonably should have known about; (c) your directions that conflict with law or safety; or (d) work by others outside our control. This does not apply to the extent caused by our sole negligence or willful misconduct.

Photos, testimonials, and portfolio use
With your consent or as permitted by contract, we may document projects and use non-sensitive photos, anonymized case details, and testimonials for our portfolio and marketing. You may withdraw consent by emailing elaine@alliancehazmat.com
. We will honor contractual confidentiality obligations.

Intellectual property
We own all rights in our preexisting materials, safety programs, procedures, templates, and methodologies. Project deliverables you fully pay for become yours to use for the project and ordinary facility operations; our internal know-how remains ours.

Confidentiality
Each party will keep the other’s non-public information confidential and use it only for the project, except where disclosure is required by law or regulator.

Privacy

Third-party links
The Site may link to third-party sites. We are not responsible for their content or practices. Review their terms and policies.

Electronic communications and signatures
By contacting us through the Site or email, you consent to receive communications electronically. We may use electronic signatures and records; they are legally binding to the fullest extent permitted by law.

Governing law and venue
These Terms and any dispute related to the Site or Services are governed by the laws of the State of California, without regard to conflict-of-law rules. State and federal courts located in California will have exclusive jurisdiction, unless your written contract specifies a different dispute process.

Dispute resolution
Before filing suit, the parties will attempt in good faith to resolve disputes through management-level discussions. If your written contract includes mediation or arbitration terms, those terms will control.

Severability
If any provision of these Terms is found unenforceable, the remaining provisions remain in full force and effect.

No waiver
A failure to enforce any provision is not a waiver of that provision.

Entire agreement
For Site use, these Terms are the entire agreement. For Services, these Terms work together with your signed estimate, proposal, PO, master service agreement, and any addenda. If there is a conflict, the signed contract documents control.
